O Acesso à Justiça em retalhos: linguagem em experimento por uma jurista-cartógrafa

Abstract

As soon as it rang, I went to answer the phone. Hello? - I asked on the other side of the line. Calls connect us with this other place, with people besides us. And during a pandemic, this became even more frequent. We didn't want to think alone. So we try to make a lot of connections here. The main one was with our grandparents. We treat this research, then, as a loving link to them. They are pages that express their stories through a child look. And the unusual encounter of this fabulation with a research takes place when a child who was enchanted by words decided to investigate access to justice and its effectiveness, using the methodology of cartography. Thus, the expressions of law are strangely analyzed. This is because today they make up the concept of justice based on modern meanings and principles. But how does access to justice, counted from the words of modernity, produce its effects, thinking from the jurist's perspective? And how else could this happen? From there, the research proposes to create an exercise of profaning the language, bringing it to common use as words of law. Thus, following a theory by Economides (1999), we relocated the study of the renewal waves of access to justice to deal with the training of the jurist himself. It is urgent that they know how to use their words in order to make them manageable, in common use, resisting the modern logic of producing inequalities. After all, language is an instrument of knowledge-power that exerts a lot of strength in the construction of this existing way of life. With this, an ethical way of life is sought, through the ethics of care in our relationships. And that is also access to justice. As a conclusion, it focuses on the process of creating a law without organs, each for itself, in daily justice practices. Specifically here, for the language and the creation of a comic book. Thus, in addition to being allocated in the area of social rights, this dissertation is linked to different areas of knowledge, such as psychology, philosophy, art and education. As a theoretical framework, Foucault (2007), Deleuze and Guattari (2013), Santos (2013) and Agamben (2009) are used. Therefore, we will profane the law, with thread and needle, sewing heterotopy (FOUCAULT, 2009) into pieces of life. See you! Tu-tu-tu-tu.
